Is design-build allowed in NY?

Yes, design-build is allowed in New York for private commercial projects, and it’s also been progressively authorized for many public works projects under the Infrastructure Investment Act and subsequent legislation. There are no restrictions on private owners using design-build for their NYC commercial fit-outs.

That said, design-build is just one of several delivery methods, and it’s not always the best fit for commercial fit-outs — especially design-conscious projects like office, retail, and showroom buildouts. The more common model on high-quality NYC commercial work is the traditional design-bid-build approach, where the owner hires an architect to lead design and then engages a general contractor to build it. This preserves design independence, gives the owner competitive pricing on the construction side, and keeps the architect accountable to the owner’s vision rather than to a builder’s bottom line.
